Identity Card to Sailing Vessel Crew 

DGS Coastal Branch Circular No. 30 of 2020

1. The process for issue of Seamen Identity Card (Sails) to crew members of sailing vessels through

online module has been redefined and firmed up as below:

1.1 An application for new seamen’s I-card through online module system shall be made only

through on-line prescribed mode in the form available in the coastal module in the DG Shipping official

website www.dgshipping.gov.in

1.2 The instructions for applicants applying for such I-cards new / renewal online are made available

in the said e-module itself. For flexibility, the steps are also indicated in the Annexure - I appended

with this SOP.

1.3 The documents required to be uploaded with application for on-line shall be as per check list

(Annexure - II) appended with this SOP.

1.4 The supportive documents of the application can be scanned and uploaded along with application

form.

1.5 The applicant shall ensure that he submits a complete and final application following the

instructions in the said e-module.

1.6 Payment of specified official fee 500/- (Five Hundred only) can be made through e-payment

gateway facilities provided in the said e-module or Bharatkosh (receipt must be enclosed).

1.7 On receipt of an application under the RO Sails shall, after conducting such inquiry, as he may

consider necessary, forward the application online to the Directorate with recommendations for issuanceof seamen’s I-card.

1.8 If the application received is deficient, the RO Sails may query back / reject the application as

the case may be.

1.9 Once the application is approved, the same may be printed on securitized booklet at the

Directorate.

1.10 On completion of printed I-cards, the concerned official at the Directorate may sign the last page

of the I-card and forward the same to the concerned RO Sails office. 

1.11 On receipt of I-cards from the Directorate, the RO Sails shall endorse / stamp the I-card and

process it for lamination.

1.12 On completion of lamination, the I-cards shall be dispatched by speed post to the given address

of applicant.

1.13 The same processes as listed in paragraphs 1.1 - 1.12 would be applicable for Renewal,

Replacement and duplicate I-cards.

2.1 Henceforth, no application, documents, fee shall be accepted in offline mode.

2.2 Any application with deficiency shall be rejected without any prejudice and fee paid therefore

may be fortified.

2.3 I-card shall stand cancelled and forfeited if any information or document found fake or

compromised at any later time/point of time under Section 46 of MS Sailing Vessel Rules, 1997.

2.4 I-card would be issued for a validity of 5 years from date of issue and hence renewal of the same

would be applicable.

Supernumeraries on board

 

 Crew Circular 5 of 2009

NO:23(30)/CR/2003-III Dated:01.07.2009 

Subject:-Guidelines for placement of Supernumeraries on board Indian flag vessels--reg.

            This circular supercedes this Directorate's earlier Crew Branch Circular 4 of 2007 dated 20.08.2007 on the subject. 

2.         Consequent to DGS-INSA meeting held on 30.04.2008, it has been decided that no prior permission of DGS is required by owners to place supernumeraries on board their vessels.  Owners, henceforth, could place supernumeraries on board their ships, subject to self certification that following guidelines are strictly complied with; 

i)           A Supernumerary other than family members of Ship's Officers, other dignitaries and Service Engineers of manufacturer of ship specific machinery/equipment (which does not include generic repair personnel/squads etc.) is required to have undergone following basic familiarization courses as per Paragraph 1 of Section A-VI/1 of the STCW Code and should be in possession of valid certificates;

Personal Survival Techniques.

Fire Prevention and Fire Fighting.

Elementary First Aid.

Personal Safety & Social Responsibility.

In cases of family members of ships officers, scientists, other dignitaries, and service Engineers of manufacturer of ship specific machinery/equipment (which does not include generic repair personnel/squads etc who are required to board the vessels for specific purpose, appropriate familiarization training to be imparted on board vessels by the Master of the vessel. 

ii)          The Master of the vessel will ensure that supernumerary(s) are carrying out the assigned functions, keeping in view the safety practices specified in the safety manual of the ship under the ISM Code. 

iii)         Total number of individuals (souls) on board the vessel including the Master, Officers, crew, family members of officers and other Supernumeraries shall not exceed (a) LSA Capacity of the vessel as per the Cargo Ship Safety Equipment Certificate and (b) the certified accommodation of the vessel excluding family members, who are to be accommodated with the respective officers.  

iv)        In exceptional cases, where the total number of individuals (souls) on board the vessel exceeds the certified accommodation, due to supernumeraries, as per the Certificate of Indian Registry, the ship owner shall ensure that the accommodation facility being provided to the supernumerary(s), will not come in the way of accommodation of crew. 

V)         The Shipowner/Manager should ensure that appropriate insurance cover from Indian insurance companies or from P&I club of the vessel is obtained for such supernumeraries, for the proposed period of voyage as applicable to the seafarers constituting the regular crew, as per the NNB/MUI agreement. 

vi)         The Shipowner/Manager should ensure that in the contract of agreement with the supernumerary(s), requisite clause is incorporated to indicate the responsibility for the repatriation of stranded supernumerary(s) or provision for repatriation of mortal remains of the deceased supernumerary(s), as the case may be. 

vii)        The Shipowner will also ensure that the mess facilities provided to the supernumerary(s) will not be at the cost of the facilities being provided to the officers and crew of the vessel. 

viii)       It shall be ensured that the supernumerary(s) shall have no claim to apply for a Continuous Discharge Certificate-cum-Seafarers' Identity Document (CDC). 

ix)        Placement of supernumerary(s) on board the vessel should be bare minimum, clearly linked with the nature of work to be executed and also specify the duration of stay which is necessary to carry out the work when in any case should not exceed 4 months. 

3.         Shipowners may kindly note that carriage of supernumeraries, in violation of these guidelines, would be viewed seriously by the DGS. In case of any Port State Control detention of the vessel on account of carriage of supernumeraries in violation of these guidelines or during any audit of the record of supernumeraries vis a vis mandatory provisions, the company's General Trading License would be liable to be forthwith suspended by DGS.  

4.         Shipowners would forward quarterly returns (Annex 'A') to the Directorate, indicating names of supernumerary, name of vessel, name of company and duration for which supernumeraries have been carried on board Indian vessel. 

5.         This issues with the approval of Director General of Shipping & Ex-Officio Addl. Secretary to Government of India.

Survey by Recognised Organizations


Statutory Certilication and Services of Indian ships by the Recognised Organizations

 DGS ORDER (06 of 2013)

Article 94 of the United Nations Convention on the Law of the Sea 1982 (UNCLOS'82) requires every flag State to effectively exercise its jurisdiction and control in administrative, technical and social matters over ships flying its flag, inter-alia through statutory surveys and certifications as aoplicable to ensure its compliance at all times within the provisions of the relevant international conventions and ndtional legislation to ensure prevention of maritime casualties and marine pollution from ships. Regulation I/6 of the 1974 SOLAS Convention and regulation 4 of Annex I and regulation 10 of Annex II of MAMOL 73178, provide that the Administration may entrust such inspections and surveys to Recognized Organizations specifically notified for the purpose. 

Govetnment of India, vide its official gazette notification No.S.O.204a(E), DG Shipping Order No. 6 of 2013, - dated 06.09.201I autherised ten Recognised Organizations (ROs) to undertake statutory certificatiot: and services of the Indian flag vessels.

IMO guideiines, particularly Resolutions A.739(19) & A789(19) require the flag States to verify that the organizations recognized to perforn: statutor.v certification and services on its behalf fulfill the requirements of the applicable international conventions

Corrigendum-3 to DGS Order 6 of 2013 

Qualification of Surveyors: The minimum qualification and experience of surveyors undertaking statutory survey and certification services of convention-ships is mentioned in the 

 Corrigendum-3 to DGS Order 6 of 2013 

 Exemptions and Extensions: 

 In case of a reported non-compliance of the M.S Act/Rules or Convention provisions, except for extension of dry-dock surveys / tail-shaft surveys, any RO with which the vessel is classed or has issued the relevant statutory certificate, may undertake a physical inspection of the vessel, including an assessment on the risk profile of the reported deficiency and the appropriateness of the alternate arrangement being proposed and promptly forward a report to the DGS with its clear recommendation. The DGS, after satisfactory assessment of the report shall advise the RO for the issuance of exemption, dispensation, statutory note or short-term certificate, as appropriate. 

In case the above is undertaken by an RO other than the IRS, copy of the certificate / note issued in this regard shall be promptly forwarded to the IRS by the concerned RO to facilitate updating on the centralized vessel history being maintained by the Society. 

 With regard to matters related to the dry-dock/tail shaft extensions and In-water surveys in lieu of dry-docking, the delegation of authority shall remain exclusively limited to the IRS, for the purpose of centralized monitoring, control and reporting. 

The extension of statutory certificates as provided under the respective Conventions, but, not needing extension of dry-dock surveys can be undertaken by any RO with which the vessel is classed or has issued the relevant statutory certificate. 

However, except for ‘green channel’ cases as provided in MSN 13 of 2012, necessary concurrence need to be obtained from the DGS prior to extending the cer

 Endorsement for Annual Surveys:

It has come to the notice of this Directorate that some of the ROs are restricting other ROs from undertaking endorsement for annual/intermediate/periodical/additional surveys Corrigendum-3 to DGS Order 6 of 2013 Page 4 on certificates issued by the former. It is therefore clarified that the statutory certificates issued on behalf of the Govt. of India can be endorsed for appropriate surveys by any RO authorised for the purpose by the GOI, regardless of the fact that the certificate may have been issued by another RO

 Surveys towards extension of docking survey

Surveys towards extension of docking survey (Corrigendum-4 to DGS Order 6 of 2013)

The following procedure shall be followed for the surveys towards extension of docking surveys/tail shaft surveys as required under MS Notice no.13 of 2012 and MS Notice no. 24 of 2009. 

(A) The green channel scheme for extension of surveys as per MS Notice 13 of 2012, shall apply to all ships below 25 years of age, irrespective of the type of ship, subject to them meeting the conditions at para (3) of the MS Notice No. 13 of 2012. 

(B) The surveys towards the grant of extension and the exemption from intermediate docking, as per M S Notice No. 13 of 2012 and MS Notice No. 24 of 2009 respectively, may be carried out by the ‘concerned RO’ (i.e., a RO with whom the vessel is classed). On satisfactory completion of surveys, the ‘concerned RO’ may grant the provisional extension Corrigendum-4 to DGS Order 6 of 2013 Page 2 (as per MS Notice 13 of 2012) or endorse the Cargo Ship Safety Construction Certificate towards intermediate docking (as per MS Notice no. 24 of 2009), as applicable. 

(C) In case of those ships that do not qualify for green channel scheme as per the revised criteria at (A), the application for extension of surveys shall be made to the Directorate along with a report of survey carried out by the ‘concerned RO’ for the purpose of extension and their recommendation. In such cases, the ‘concerned RO’ shall carry out a detailed survey of the ship in accordance with MS Notice no.13 of 2012, and hand over their survey report, findings and clear recommendation to the owners for submission to the Directorate. (D) All other contents of MS Notice 13 of 2012 and MS Notice 24 of 2009 shall remain unchanged.

As per the 20I8UNEP repon titled Single-use plostics- A Roadmap for Sustainahiltty. singlc-usc plastics are also knolvn as disposable Plastics like plastic bags. straws. coffee srirrers- soda and water bottles and food packaging, which are used only once before rhey are thrown away or recycled. IMO adopted Resolution MEPC.295(71)12017: Guideljnes for the implementation of MARPOL ANNEX V on 7'h July 2017.

Applicabilitv of ban:

1. All Ships which are deemed to be Indian Ships under Merchant Shipping Act,1958.

2. Foreign ships in any port or place in lndia.

Prohibitions:

5. Microwave dishes. ice cream tubs, potato chip bags, bottlc caps:

1. Cutlery. plates and cups;

2.Up-to 10 litres bottles for water and other drinks;

3. Garbage and shopping bags, ard

4. Dispensing conlainers for cleaning fluids which are less than 10 lirres volume.

Enforcement

Indian ships. ln case of non-compliance! a dehciency rais€d lo be reclified prior departue under Code 99103 (Other MARPOL Operational). lf same deficiency is repeated during next inspection, it may be taken as a clear grcund for detention under ISM Code.

A foreign ships intending to enter an Indian port (as defined in Anicle l1 of UNCLOS), is required to make a log entry identifying the "Single Use Plastic Items" on board the ship and stating the time, latitude and longitude when" along with the location of the store where these items are stored prior entering Indian tenitorial waters. Further no single use plastic items to be discharged to port reception facility at an Indian port; same to be verified during Pon State Inspections.

No detention of foreign ships to be enforced. In case it is found necessary, after uploading all other deficiencies on IOCIS website. a handwritten deficiency in rhe printed PSC Form 'B' to be rectified prior departure may be issued; however. no such deficielcy to be uploaded on IOCIS.

2. Adundum No1 to DGS order 5 of 2019

Definition ofSingle usc plastic (SUl'):

DGS Order 5 of2019 defines SUP as "disposable plastics which are used only once and then thrown away by the user". It is clarified that the said definition does not include all those plastic items, which are re-used on ships.

The definition ol SUP includes only those items, which are completely made of plastics, and items such as juice/milk packets / tetra-packs with plastic lining or caps are not included in this definition. Biodegradabte plastic with a stamp, marking or certificate from the manufacturer' or something similar shall not be considered for prohibition. Non-biodegradable multi-layered packaging shall also be considered for prohibition.

The said prohibition is applicable t0 items used on board ship and excludcs cargo related items and Packaging.

Crew and passenger personnel effects are now excluded from this prohibition titl such time an execution plan is decided. at a later date. for these items and / or issued tide AtllenJum .\o. ) -

Necessarl items such as Personal Protective Equipment. medicines. medicinal equipment, life-saving appliances. tire fighting appliances, and olher statutory items used on such equipment,s which are made up of sUP or contained in SUP are excluded from Prohibition.

Registration of Ships

Whereas Part V of the Merchant Shipping Act, 1958, and the Merchant Shipping (Registration of Indian Ships) Rules, 1960 as amended in 1966, 1970, 1994 and 1997, by the Central Government provide for and prescribe the procedure for registration and provisional registration of Indian ships,

Whereas a need is felt by the Shipping industry for detailed guidelines in this regard including entry of mortgages easily and urgently on the register book to enable and satisfy the Banks or financial institutions in India and abroad, lending money for acquisition of Indian ships,

Whereas the shipowners of today cannot afford to have vessels delayed after their acquisition till registration formalities are completed, and maritime administrations elsewhere in the world accord registration in less than a few hours, thereby enabling the shipowners to choose their flag and thus attract all the cascading benefits arising therefrom,

Whereas our present practice has resulted sometimes in registration of Indian ships being delayed, and the registration of a ship is only the identification of the ship and of the owner, and is not related to survey of the vessel and the statutory/convention requirements, and the ship after registration can still be stopped from trading or sailing, if she does not meet with the statutory requirements;

Whereas many of the Indian Shipping companies have been finding the registration formalities for ships in India to be long-drawn-out, and therefore are tempted to acquire ships abroad through their foreign subsidiaries and register them in countries which have liberalized procedure for registration/ provisional registration/entry of mortgage;

Whereas the Government of India, Ministry of Shipping issued Office Memorandum No.SD-11018/1/97-MD dated 15 June 2001, and thereafter dated 5 March 2002 requiring the Director General of Shipping to issue detailed guidelines on registration of Indian Ships;

And whereas the powers conferred by clause(1) of Section 456 of the Merchant Shipping Act, 1958 on the Central Government, read with notification issued by Government of India vide S.O. No.3144 dated 17th December, 1960 have been delegated to him to enable him to order what ought to be exempted or dispensed with in the circumstances of the case,

Now, therefore, the Director General of Shipping and ex-Officio Additional Secretary to the Government of India in the Ministry of Shipping is hereby pleased to issue this order comprising some revised and new guidelines for registration of Indian ships, provisional registration of Indian ships and entry of mortgage:-

1. On receipt of all the documents required for registration of the ship, the Registrar shall ensure grant of certificate of permanent registration to the ship immediately, in any case within three working days.

2. Permission of the Director General of Shipping to register a ship, if a ship is built in shipyard other than an Indian Shipyard, as required vide clause (d) of Rule 3 shall no longer be necessary.

3. Tonnage measured in accordance with the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1987 as applicable or tonnage certificate issued by the previous maritime administration shall be accepted for the purpose of registration.

4. When the ship is acquired abroad, the present practice of granting provisional registry to the ship by the Indian Consular Officer shall continue. The Registrar of Ships shall send detailed message to Indian High Commission/Embassy about the provisional registration. The sighting of Carving and Marking on the ship and the endorsement of the Carving and Marking note should be done by a Surveyor of Mercantile Marine Department or of a Recognized Classification Society.

5. For the provisional registry of ship, the Registrar shall open a page in the Register. Whenever the permanent registration is conferred, the same page shall be used by replacing the word 'provisional' with 'permanent' on the same page. While the serial number of the ship will remain the same, the date of registry shall be in two parts, one date for provisional and another for permanent registration.

6. Mortgage shall also be entered on provisional registry of ships. The Registrar shall also issue a letter to the Bank/Financial institution stating, that once the mortgage is entered on provisional registration, the said mortgage will continue to remain in force even after the said ship has been granted permanent registration.

7. On presentation of the mortgage instrument to the Registrar of the ship's port of registry, the Registrar shall proceed to record the mortgage transaction in the register book with the date and hour of acceptance and shall also endorse on the mortgage instrument the fact of recording and the date and hour of acceptance. The Registrar shall also issue a letter stating that on permanent registry of the ship, the mortgage will be automatically transferred on the permanent registry.

8. The second and any subsequent mortgage on a ship will be recorded in the register of the ships only after No objection Certificate (NoC) from the first or any existing mortgagee has been obtained.

9. When the registered mortgage is discharged, the Registrar shall, on production of the mortgage deed with discharge duly signed, after satisfying himself that the discharge on the mortgage instrument is in order and that it is properly witnessed, make the entry relating to the discharge in the register book. When a joint mortgage is created in favour of two or more mortgagees and when the mortgage is released by one of the mortgagees, the Registrar shall on production of evidence relating to release of mortgage, make the entry relating to the discharge of the mortgage by one of the mortgagees in the register book by way of modification of the mortgage.

10. The registration of creation, modification or discharge of the mortgage with the Registrar of Companies shall not be a pre-requisite to enter the mortgage in the Register.

11. The fees for entering every mortgage will be 10 paise for every Rs.1000/- of the value of the mortgage for the entry of mortgage on the first ship. If the loan amount involves creation of mortgage on more than one vessel, the fee chargeable for entering the mortgage on second and subsequent vessel would be Rs. 500/- only. In case of additional amount being sanctioned by the same mortgagee leading to additional mortgage, the fee for registration will be charged only for the additional amount.

Sub: Revised Guidelines for Registration of Ships, etc - Amendment reg.


In partial modification of the Directorate General of Shipping's Order No. 2 of 2002 (No. SD-13/POL(5)/2001 dated 02.05.2002) on 'Revised Guidelines for Registration of Ships etc.', paragraph 4 stands amended as under :

Paragraph 4 : When the ship is acquired abroad, the present practice of granting provisional registry to the ship by the Indian Consular Officer shall continue. In addition, the attending Surveyor of the Mercantile Marine Department/Indian Register of Shipping is also authorized to issue Provisional Certificate of Registry. The Registrar of Ships shall send detailed message including procedural guidelines to such attending Surveyor. The sighting of Carving and Marking and endorsement of "Carving and Marking Note" may be done by a Surveyor of the Mercantile Marine Department, Indian Register of Shipping or of any Classification Society, which is a member of International Association of Classification Societies (IACS).

These amendments to DG Shipping Order No. 2 of 2002 shall come into force with immediate effect.
